The bill amends section 948.15 of the Florida Statutes to increase the probationary periods for certain misdemeanor offenses related to controlled or chemical substances. Specifically, it allows for probation supervision for defendants found guilty of misdemeanors involving possession of a controlled substance, controlled substance analogs, or chemical substances to be extended up to one year if these substances are significant factors in the offense. The current maximum probation period of six months remains unchanged for other misdemeanor offenses unless specified otherwise by the court.
The new legal language inserted into the statute clarifies the definitions of the substances involved, including "a controlled substance, as defined in s. 893.02; a controlled substance analog, as described in s. 893.0356; or a chemical substance described in s. 877.111(1)." This bill is set to take effect on July 1, 2025.
