This bill amends Florida Statutes sections 468.1265 and 484.054 to authorize the distribution and sale of prescription hearing aids through the mail to patients aged 18 and older, under specific conditions. The amendments allow for the mailing of hearing aids prior to a scheduled telehealth appointment with a licensed audiologist or hearing aid specialist, provided that the audiologist or specialist conducts a fitting during the appointment or a subsequent one to ensure the proper fit and functionality of the devices. The bill also stipulates that the hearing aids cannot be activated until they have been prescribed by the respective professional.
Additionally, the bill clarifies that it is unlawful for any person to sell or distribute prescription hearing aids through the mail to consumers, except as outlined in the new provisions. Violations of these regulations are classified as misdemeanors of the second degree. The effective date for this act is set for July 1, 2025.
