The bill amends section 825.1035 of the Florida Statutes to enhance protections for vulnerable adults against exploitation, particularly in cases where the respondent's identity is unascertainable. It introduces a new subsection (8) that defines an "unascertainable respondent" as someone whose identity cannot be determined and who has communicated with the vulnerable adult in a way that makes tracing their identity impractical. The bill allows for substitute service on such respondents, requiring petitioners to file a sworn affidavit detailing their attempts to identify the respondent and the nature of their communication with the vulnerable adult.

Additionally, the bill mandates that once the affidavit is filed, the court must order the petitioner to serve the unascertainable respondent through the same means of communication used by the respondent. It also stipulates that any proposed transfer of funds or property in dispute must be held for 30 days following the issuance of a final order of injunction. The effective date for this act is set for July 1, 2025.
