The legislation appropriates $1.722 million from the General Revenue Fund to compensate Mr. Holmes for his wrongful conviction and directs the Chief Financial Officer to issue a warrant for this amount payable directly to him. Additionally, the bill waives tuition and fees for Mr. Holmes for up to 120 hours of instruction at designated educational institutions, contingent upon his meeting the admission and academic requirements.
The bill also includes provisions that protect the state from liability, stating that the Legislature does not waive any defenses of sovereign immunity and that the funds awarded cannot be used for attorney or lobbying fees. Furthermore, upon receiving the compensation, Mr. Holmes is prohibited from submitting a compensation application under existing statutes. The legislation declares that if future judicial findings indicate Mr. Holmes' involvement in the crime, any unused benefits under this act will be void. The act is set to take effect upon becoming law.
