This bill provides for the relief of the Estate of M.N. by the Broward County Sheriff's Office (BSO) due to negligence that resulted in M.N.'s injuries and subsequent death. The bill appropriates $2,498,258.50 to compensate the estate for damages, which includes a jury award of $4.5 million, of which 58 percent was attributed to the BSO. The bill acknowledges the BSO's failure to conduct a thorough child protective investigation, which led to M.N. being discharged into an unsafe environment, ultimately resulting in her death. The bill also stipulates that the BSO is responsible for paying this amount from unencumbered funds.
Additionally, the bill includes provisions to waive all government liens, including Medicaid liens, related to M.N.'s treatment and care. It establishes that the compensation provided under this act is intended to be the sole remedy for all claims arising from the circumstances surrounding M.N.'s injuries and death. Furthermore, it limits attorney fees related to this claim to a maximum of 25 percent of the total amount awarded. The bill is set to take effect upon becoming law.
