As a result of the department's negligence, C.C. experienced significant health issues, including anoxic brain injury and other permanent impairments, necessitating lifelong care.

To address the damages sustained by C.C., the bill appropriates $20 million from the General Revenue Fund to be paid to an irrevocable trust for C.C.'s benefit. The trust will cover attorney fees and related expenses, with a cap of 25% of the total amount awarded for such costs. The bill also declares the facts stated in the preamble to be true and outlines the financial responsibilities of the Chief Financial Officer in disbursing the funds. The act is set to take effect upon becoming law.
