1 A bill to be entitled
2 An act relating to private aircraft landing
3 requirements; creating s. 330.42, F.S.; prohibiting a
4 private aircraft from landing at an airport owned or
5 operated by a commercial airport authority created by
6 the Legislature as a dependent special district unless
7 certain requirements are met; authorizing the airport
8 authority to impose certain additional requirements
9 for certain private aircraft; authorizing the airport
10 authority to require documentation that such
11 requirements have been met; providing an effective
12 date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 330.42, Florida Statutes, is created to
17 read:
18 330.42 Private aircraft landing standards.—
19 (1) A private aircraft may not land at an airport owned or
20 operated by a commercial airport authority created by the
21 Legislature as a dependent special district unless:
22 (a) The aircraft meets Federal Aviation Administration
23 guidelines for Stage 3 operating noise standards when landing.
24 (b) The weight of the aircraft does not exceed the runway
25 pavement classification for aircraft weight per International

26 Civil Aviation Organization standards for such airport.
27 (2) In addition to the requirements provided in subsection
28 (1), the airport authority may impose the following requirements
29 for a private aircraft that weighs at least 75,000 pounds but
30 not more than 125,000 pounds:
31 (a) Such aircraft's landing frequency and timelines may
32 not exceed 20 landings per year and may not interfere with
33 daytime airport operations.
34 (b) Landing fees for such aircraft may be higher than
35 landing fees for other aircraft.
36 (c) The operator of the aircraft must pay for appropriate
37 hangar and storage facilities.
38 (3) Before initial landing at an airport owned or operated
39 by the airport authority, and annually thereafter, the airport
40 authority may require the operator of a private aircraft to
41 provide documentation that the requirements imposed under this
42 section have been met.
43 Section 2. This act shall take effect July 1, 2024.
