1 A bill to be entitled
2 An act relating to affordable housing inclusionary
3 housing ordinances; amending ss. 125.01055 and
4 166.04151, F.S.; requiring, rather than authorizing,
5 inclusionary housing ordinances to require developers
6 to provide a specified number or percentage of
7 affordable housing units; deleting the authorization
8 for a developer to contribute to a housing fund or
9 other alternatives in lieu of building affordable
10 housing units; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (2) of section 125.01055, Florida
15 Statutes, is amended to read:
16 125.01055 Affordable housing.—
17 (2) An inclusionary housing ordinance must may require a
18 developer to provide a specified number or percentage of
19 affordable housing units to be included in a development or
20 allow a developer to contribute to a housing fund or other
21 alternatives in lieu of building the affordable housing units.
22 Section 2. Subsection (2) of section 166.04151, Florida
23 Statutes, is amended to read:
24 166.04151 Affordable housing.—
25 (2) An inclusionary housing ordinance must may require a
