1 A bill to be entitled
2 An act relating to storage of firearms in motor
3 vehicles or vessels; creating s. 790.176, F.S.;
4 providing definitions; providing requirements for
5 storage of firearms and ammunition in motor vehicles
6 or vessels; providing criminal penalties; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 790.176, Florida Statutes, is created
12 to read:
13 790.176 Storage of firearms in motor vehicles or vessels. —
14 (1) As used in this section, the term:
15 (a) "Motor vehicle" has the same meaning as in s.
16 320.01(1).
17 (b) "Trunk" means the fully enclosed and locked main
18 storage compartment of a motor vehicle that is not accessible
19 from the passenger compartment, but does not include any
20 compartment that has a window; the bed of a pickup truck; or the
21 rear area of a hatchback, station wagon-type motor vehicle, or
22 sport utility motor vehicle.
23 (c) "Vessel" has the same meaning as in s. 327.02.
24 (2) A person who stores or leaves, in a motor vehicle or
25 vessel under his or her control, a firearm, whether loaded or

26 unloaded, or firearm ammunition, while the person is not in the
27 motor vehicle or vessel, shall keep the firearm from ordinary
28 observation locked within the trunk, a utility or glove box, or
29 a locked container securely affixed to the motor vehicle or
30 vessel.
31 (3) A person who violates subsection (2) commits a
32 misdemeanor of the second degree, punishable as provided in s.
33 775.082 or s. 775.083.
34 Section 2. This act shall take effect upon becoming a law.
