1 A bill to be entitled
2 An act relating to fees; amending s. 560.502, F.S.;
3 providing nonrefundable fees for registration,
4 registration renewal, and late registration renewal
5 applications as virtual currency kiosk businesses;
6 providing that registration fees are not prorated;
7 providing a contingent effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (a) of subsection (3) of section
12 560.502, Florida Statutes, as created by HB 977, 2024 Regular
13 Session, is amended, paragraph (c) is added to subsection (1),
14 and paragraphs (c) and (d) are added to subsection (4) of that
15 section, to read:
16 560.502 Virtual currency kiosk business registration.—
17 (1) To conduct business as a virtual currency kiosk
18 business, a person or entity must register with the office as a
19 virtual currency kiosk business by submitting all of the
20 following:
21 (c) A nonrefundable registration fee equal to the lice nse
22 application fee in s. 560.143(1)(b).
23 (3)(a) Registrations are to be renewed annually by
24 December 31 of the year of expiration. There shall be no
25 proration of the fee for any registration. To renew such

26 registration, the registrant must submit to the office all of
27 the following:
28 1. The information required in subsection (2), or an
29 attestation stating that all the information remains the same as
30 the prior year.
31 2. Upon request, evidence that the registrant has been
32 operating in compliance with this part, as the commission may
33 require by rule, including, but not limited to:
34 a. Current disclosures presented to customers during the
35 transaction process.
36 b. Current use of blockchain analytics to prevent
37 transfers to wallet addresses linked to known criminal activity.
38 3. A nonrefundable registration renewal fee equal to the
39 license renewal fee in s. 560.143(2)(b).
40 (4) A virtual currency kiosk business that does not renew
41 its registration by December 31 of the year of expiration shall
42 become inactive. A virtual currency kiosk business may not
43 conduct business while its registration is inactive. The virtual
44 currency kiosk business may renew its inactive registration
45 within 60 days after the first day its registration becomes
46 inactive by submitting all of the following:
47 (c) A nonrefundable late registration renewal fee equal to
48 the late license renewal fee in s. 560.143(3)(b).
49 (d) A nonrefundable registration renewal fee equal to the
50 license renewal fee in s. 560.143(2)(b).

51 Section 2. This act shall take effect on the same date
52 that HB 977 or similar legislation takes effect, if such
53 legislation is adopted in the same legislative session or an
54 extension thereof and becomes a law.
