3 revising provisions concerning specified activities
4 involving iguanas; creating s. 828.32, F.S.; providing
5 definitions; prohibiting pet stores from selling or
6 offering for sale domestic dogs and cats; providing
7 penalties; providing construction; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (a) of subsection (2) of section
13 379.372, Florida Statutes, is amended to read:
14 379.372 Capturing, keeping, possessing, transporting, or
15 exhibiting venomous reptiles, reptiles of concern, conditiona l
16 reptiles, or prohibited reptiles; license required. —
17 (2)(a) A person, party, firm, association, or corporation
18 may not keep, possess, import into the state, sell, barter,
19 trade, or breed the following species except for educational,
20 research, or eradication or control purposes:
21 1. Burmese or Indian python (Python molurus).
22 2. Reticulated python (Python reticulatus).
23 3. Northern African python (Python sebae).
24 4. Southern African python (Python natalensis).
25 5. Amethystine or scrub python (Morelia amethystinus).

26 6. Green Anaconda (Eunectes murinus).
27 7. Nile monitor (Varanus niloticus).
28 8. Green Iguana (Iguana iguana).
29 9. Tegu lizard (any species of the genera Salvator or
30 Tupinambis).
31 10. Any other reptile designated as a conditional or
32 prohibited species by the commission.
33 Section 2. Section 828.32, Florida Statutes, is created to
34 read:
35 828.32 Retail sale of domestic dogs and cats.—
36 (1) As used in this section, the term:
37 (a) "Pet store" means a business that sells or offers for
38 sale animals to the public at retail for profit. The term does
39 not include a person who sells or offers for sale directly to
40 the public only animals that the person bred and raised.
41 (b) "Sell" or "offer for sale" means to advertise or
42 display for sale, barter, or trade.
43 (2) A pet store may not sell or offer for sale a domestic
44 dog or cat.
45 (3) The sale or offer for sale of a domestic dog or cat in
46 violation of this section is a noncriminal violation, punishable
47 as provided in s. 775.083. Each such sale or offer for sale
48 constitutes a separate offense.
49 (4) This section does not prohibit the enactment or
50 enforcement of a municipal or county ordinance restricting the

51 sale or offer for sale of animals that is more stringent than
52 this section.
53 Section 3. This act shall take effect July 1, 2024.
