1 A bill to be entitled
2 An act relating to community-based mobile crisis
3 intervention services; creating s. 409.90637, F.S.;
4 requiring the Agency for Health Care Administration to
5 provide coverage for community-based mobile crisis
6 intervention services for Medicaid recipients, subject
7 to the availability of funds and specified limitations
8 or directions; requiring the agency to perform certain
9 duties by a specified date, including seeking federal
10 approval and waivers for such coverage; requiring the
11 agency to adopt rules; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 409.90637, Florida Statutes, is created
16 to read:
17 409.90637 Coverage of community-based mobile crisis
18 intervention services for Medicaid recipients.—
19 (1) Subject to the availability of funds and subject to any
20 limitations or directions provided in the General Appropriations
21 Act, the agency shall provide coverage for community-based
22 mobile crisis intervention services for Medicaid recipients.
23 (2) By January 1, 2025, the agency shall:
24 (a) Develop a plan to provide coverage for community-based
25 mobile crisis intervention services for Medicaid recipients.
26 (b) Before seeking the federal approval and federal waivers
27 required under paragraph (c), consult with entities and other
28 state and local agencies that fund, or that have an interest in
29 funding, community-based mobile crisis intervention services,
30 including, but not limited to, the Department of Children and
31 Families, the Department of Education, local governments, law
32 enforcement agencies, school districts, managing entities, and
33 managed care plans as defined in s. 409.962.
34 (c) Seek:
35 1. Federal approval for a Medicaid state plan amendment for
36 the plan to provide coverage for community-based mobile crisis
37 intervention services for Medicaid recipients.
38 2. Any federal waivers necessary for the implementation of
39 such plan, including any waivers necessary to obtain federal
40 finances to secure Title XIX matching funds for the plan. The
41 federal waiver application must seek Medicaid matching funds for
42 all general revenue, family contributions, and local
43 contributions.
44 (3) The agency shall adopt rules to implement and
45 administer this section.
46 Section 2. This act shall take effect July 1, 2024.
