3 s. 849.0932, F.S.; defining the term "fantasy sports
4 contest"; providing requirements for fantasy sports
5 contests; providing penalties; amending s. 849.142,
6 F.S.; providing an exemption from specified laws for
7 certain fantasy sports contests; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 849.0932, Florida Statutes, is created
13 to read:
14 849.0932 Fantasy sports contests; conditions for conduct. —
15 (1) As used in this section the term "fantasy sports
16 contest" includes simulation sports games and means a contest in
17 which a participant pays an entry fee and manages a fantasy or
18 simulation sports team composed of athletes from a professional
19 sports organization with the opportunity to win a cash prize.
20 (2) Fantasy sports contests must meet each of the
21 following requirements:
22 (a) Prizes and awards for the winning participants must be
23 established and disclosed to contest participants before entry.
24 (b) All winning outcomes reflect the relative knowledge
25 and skill of the fantasy sports contest participant.

26 (c) All winning outcomes are determined predominantly by
27 accumulated statistical results of the performance of more than
28 one individual.
29 (d) A winning outcome may not be based on:
30 1. The score, point spread, or performance of a team or
31 combination of teams.
32 2. The single performance of an individual in a single
33 event or a pari-mutuel event, as the term "pari-mutuel" is
34 defined in s. 550.002, Florida Statutes, as of January 1, 2021.
35 3. A game of poker or other card game.
36 4. The performance of participants in collegiate, high
37 school, or youth sporting events.
38 (e) Casino graphics, themes, or titles, including, but not
39 limited to, depictions of slot machine-style symbols, cards,
40 dice, craps, roulette, or lotto, may not be displayed or
41 depicted.
42 (3) A violation of this section is punishable by a fine of
43 $1,000. The Attorney General or state attorney may institute
44 proceedings to enjoin any person found to be violating this
45 section.
46 (4) Any person who willfully and knowingly violates any
47 provision of this section commits a misdemeanor of the first
48 degree, punishable as provided in s. 775.082 or s. 775.083.
49 Section 2. Subsection (7) is added to section 849.142,
50 Florida Statutes, to read:

51 849.142 Exempted activities.—Sections 849.01, 849.08,
52 849.09, 849.11, 849.14, and 849.25 do not apply to participation
53 in or the conduct of any of the following activities:
54 (7) Fantasy sports contests conducted pursuant to s.
55 849.0932.
56 Section 3. This act shall take effect July 1, 2024.
