1 A bill to be entitled
2 An act relating to distilled spirits; amending s.
3 565.10, F.S.; increasing the size of distilled spirits
4 containers that may be sold or distributed by a
5 distributor or vendor; amending s. 565.17, F.S.;
6 authorizing certain entities to conduct spirituous
7 beverage tastings; authorizing certain entities to
8 conduct tastings and sales at specified locations;
9 providing requirements related to the issuance of
10 permits; providing that a broker or sales agent may be
11 used in place of a distillery representative at a
12 spirituous beverage tasting; providing an effective
13 date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Section 565.10, Florida Statutes, is amended to
18 read:
19 565.10 Distilled spirits container limit.—It is unlawful
20 for any distributor or vendor to sell or distribute distilled
21 spirits in any size container in excess of 1.8 1.75 liters or
22 60.87 59.18 ounces. The division is authorized to make
23 reasonable rules in accordance with chapter 120 governing the
24 standards of fill of distilled spirits containers, which rules
25 shall not conflict with or be more stringent than the federal

26 regulations pertaining to such standards of fill of distilled
27 spirits containers.
28 Section 2. Section 565.17, Florida Statutes, is amended to
29 read:
30 565.17 Beverage tastings by distributors, craft
31 distilleries, and vendors.—
32 (1) A licensed distributor of spirituous beverages, a
33 distillery or craft distillery as defined in s. 565.03(1) or
34 licensed in any other state to manufacture distilled spirits, a
35 primary American source of supply as defined in s. 565.095(1) s.
36 565.03, or any vendor may is authorized to conduct spirituous
37 beverage tastings upon any licensed premises authorized to sell
38 spirituous beverages by package or for consumption on premises
39 without being in violation of s. 561.42, provided that the
40 conduct of the spirituous beverage tasting is shall be limited
41 to and directed toward the general public of the age of legal
42 consumption.
43 (2) A distillery, craft distillery, or primary American
44 source of supply distilleries may conduct tastings and sales of
45 distilled spirits produced by the craft distilleries at Florida
46 fairs, trade shows, farmers markets, expositions, and festivals.
47 The division shall issue permits to craft distilleries for such
48 tastings and sales. A distillery, craft distillery, or primary
49 American source of supply must pay all entry fees and must have
50 a distillery representative, broker, or sales agent present

51 during the event. The permit is limited to the duration and
52 physical location of the event.
53 Section 3. This act shall take effect July 1, 2024.
