5 municipality to be acquired by the county or
6 municipality through eminent domain; creating s.
7 403.8111, F.S.; preempting regulation of specified
8 dredge and fill activities to the Department of
9 Environmental Protection; providing construction;
10 repealing s. 373.591, F.S., relating to land
11 management review teams; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (8) is added to section 373.421,
16 Florida Statutes, to read:
17 373.421 Delineation methods; formal determinations.—
18 (8) Buffer zones for land or water delineations
19 established by a county or municipality that exceed the
20 delineation determinations for such land or water by the
21 Department of Environmental Protection or a water management
22 district must be acquired by the county or municipality through
23 eminent domain pursuant to chapters 73 and 74.
24 Section 2. Section 403.8111, Florida Statutes, is created
25 to read:

26 403.8111 Dredge and fill activities preemption.—The
27 regulation of dredge and fill activities under this chapter and
28 chapter 373 is preempted to the department. This section does
29 not preclude the authority of the department to delegate powers
30 to water management districts under chapter 373.
31 Section 3. Section 373.591, Florida Statutes, is repealed.
32 Section 4. This act shall take effect July 1, 2024.
