1 A bill to be entitled
2 An act relating to conditions of pretrial release;
3 amending s. 903.047, F.S.; providing requirements
4 concerning release of a defendant when a secure
5 continuous remote alcohol monitor is required as a
6 condition of release; prohibiting a defendant from
7 being required to surrender a license to carry a
8 concealed weapon or concealed firearm in conjunction
9 with a first misdemeanor offense except in certain
10 circumstances; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsections (3) and (4) are added to section
15 903.047, Florida Statutes, to read:
16 903.047 Conditions of pretrial release.—
17 (3)(a) If a secure continuous remote alcohol monitor is
18 required as a condition of release, the defendant's release may
19 not be delayed more than 2 hours after the oral pronouncement of
20 the order if the defendant is to be released on his or her own
21 recognizance or, if there is a monetary component to the
22 release, more than 2 hours after the defendant's bail or bond is
23 posted.
24 (b) A requirement of a secure continuous remote alcohol
25 monitor vendor to have a cosignor for the monitoring device or

26 payment from a person other than the defendant may not delay the
27 defendant's release. Such a vendor requirement must be
28 established no later than 24 hours after the defendant's
29 release.
30 (c) A secure continuous remote alcohol monitor may not be
31 required for a first misdemeanor offense unless it is shown by
32 clear and convincing evidence that such a monitor is required to
33 protect the public safety.
34 (4) Notwithstanding any other law, a defendant may not be
35 required to surrender a license to carry a concealed weapon or
36 concealed firearm in conjunction with a first misdemeanor
37 offense unless it appears that the defendant would present a
38 danger to the public if he or she were to possess the concealed
39 weapon or concealed firearm.
40 Section 2. This act shall take effect July 1, 2024.
