2 An act relating to proprietorship by nonphysicians;
3 creating s. 458.45, F.S.; prohibiting certain acts by
4 persons or entities other than licensed physicians and
5 licensed entities; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 458.45, Florida Statutes, is created to
10 read:
11 458.45 Proprietorship by nonphysicians.—A person other
12 than a physician licensed pursuant to this chapter, or an entity
13 other than a group of physicians, a not-for-profit hospital, or
14 a medical school licensed pursuant to general law, may not:
15 (1) Employ a physician.
16 (2) Direct, control, or interfere with a physician's
17 clinical judgment.
18 (3) Have a relationship with a physician that would allow
19 the unlicensed person or entity to exercise control over:
20 (a) The selection of a course of treatment for a patient,
21 the procedures or materials to be used as part of such course o f
22 treatment, and the manner in which such course of treatment is
23 carried out by the physician.
24 (b) The patient records of the physician.
25 (c) Policies and decisions relating to billing and

26 advertising.
27 (d) Policies and decisions relating to physician staffing,
28 office personnel, and hours of practice.
29 Section 2. This act shall take effect July 1, 2024.
