1 A bill to be entitled
2 An act relating to evictions during emergency
3 conditions; amending s. 83.62, F.S.; prohibiting a
4 sheriff from serving or executing a writ of possession
5 until a specified time on certain premises that are
6 under a hurricane watch or hurricane warning; tolling
7 the notice period for a writ of possession issued on
8 certain premises that are under a hurricane watch or
9 hurricane warning; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (1) of section 83.62, Florida
14 Statutes, is amended to read:
15 83.62 Restoration of possession to landlord.—
16 (1) In an action for possession, after entry of judgment
17 in favor of the landlord, the clerk shall issue a writ to the
18 sheriff describing the premises and commanding the sheriff to
19 put the landlord in possession after 24 hours' notice
20 conspicuously posted on the premises.
21 (a) The sheriff may not serve or execute a writ of
22 possession on a premises in a county that is under a hurricane
23 watch or hurricane warning issued by the National Weather
24 Service until 5 days after the termination of the hurricane
25 watch or hurricane warning.

26 (b) Saturdays, Sundays, and legal holidays do not stay the
27 24-hour notice period. However, if the premises is located in a
28 county that is under a hurricane watch or hurricane warning
29 issued by the National Weather Service, the 24-hour notice
30 period is tolled until 5 days after the termination of the
31 hurricane watch or hurricane warning.
32 Section 2. This act shall take effect July 1, 2024.
