1 A bill to be entitled
2 An act relating to continuing chiropractic education;
3 amending s. 460.408, F.S.; deleting a requirement that
4 chiropractic continuing education be completed in a
5 classroom setting; prohibiting the Board of
6 Chiropractic Medicine from limiting the number of
7 approved continuing education hours that may be
8 completed through distance learning; authorizing the
9 board to provide exceptions to continuing education
10 requirements during a declared state of emergency;
11 providing requirements for continuing education
12 instructors; requiring the board to adopt rules;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Section 460.408, Florida Statutes, is amended
18 to read:
19 460.408 Continuing chiropractic education.—
20 (1) The board shall require licensees to periodically
21 demonstrate their professional competence as a condition of
22 renewal of a license by completing up to 40 contact classroom
23 hours of continuing education.
24 (a) Continuing education courses sponsored by chiropractic
25 colleges whose graduates are eligible for examination under any

26 provision of this chapter may be approved upon review by the
27 board if all other requirements of board rules setting forth
28 criteria for course approval are met.
29 (b) The board shall approve those courses that build upon
30 the basic courses required for the practice of chiropractic
31 medicine, and the board may also approve courses in adjunctive
32 modalities. Courses that consist of instruction in the use,
33 application, prescription, recommendation, or administration of
34 a specific company's brand of products or services are not
35 eligible for approval.
36 (c) The board may not limit the number of approved
37 continuing education hours that may be completed through
38 distance learning.
39 (2) The board may provide exceptions to make exception
40 from the requirements of this section in emergency or hardship
41 cases and during a declared state of emergency.
42 (3) Continuing education courses shall be taught by an
43 instructor with at least one of the following qualifications:
44 (a) Holds a postgraduate degree, or bachelor's degree with
45 at least 2 years' experience in the subject matter taught.
46 (b) Is a current faculty member of a chiropractic college
47 or school maintaining a standard and reputability approved by
48 the board or is a current faculty member at a medical or an
49 osteopathic college or a university accredited by, or having
50 status with, an accrediting body recognized by the Council for

51 Higher Education Accreditation or its successor or the United
52 States Department of Education.
53 (c) Is a postgraduate-level instructor at a chiropractic
54 college or school maintaining a standard and reputability
55 approved by the board, or a postgraduate-level instructor at a
56 medical or an osteopathic college or a university accredited by,
57 or having status with, an accrediting body recognized by the
58 Office of Postsecondary Education or its successor or the United
59 States Department of Education.
60 (4)(3) The board shall may adopt rules to implement within
61 the requirements of this section that are necessary for its
62 implementation.
63 Section 2. This act shall take effect July 1, 2024.
