1 A bill to be entitled
2 An act relating to community-based mobile crisis
3 intervention services; creating s. 409.90637, F.S.;
4 requiring the Agency for Health Care Administration to
5 provide coverage for community-based mobile crisis
6 intervention services for Medicaid recipients;
7 providing duties of the agency to be accomplished by a
8 date certain; requiring the agency to seek federal
9 approval and waivers for such coverage by a date
10 certain; requiring the agency to adopt rules;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 409.90637, Florida Statutes, is created
16 to read:
17 409.90637 Coverage for community-based mobile crisis
18 intervention services.—
19 (1) Subject to the availability of funds and subject to
20 any limitations or directions provided in the General
21 Appropriations Act, the agency shall provide coverage for
22 community-based mobile crisis intervention services for Medicaid
23 recipients.
24 (2) By January 1, 2025, the agency shall:
25 (a) Develop a plan to provide coverage for community -based

26 mobile crisis intervention services for Medicaid recipients.
27 (b) Before seeking the federal approval and federal
28 waivers under paragraph (c), consult with entities and other
29 state and local agencies that fund, or that have an interest in
30 funding, the community-based mobile crisis intervention
31 services, including, but not limited to, the Department of
32 Children and Families, the Department of Education, local
33 governments, law enforcement agencies, school districts,
34 managing entities, and managed care plans as defined in s.
35 409.962.
36 (c) Seek:
37 1. Federal approval for a Medicaid state plan amendment
38 for the plan to provide coverage for community-based mobile
39 crisis intervention services for Medicaid recipients.
40 2. Any federal waivers necessary for the implementation of
41 such plan, including any waivers necessary to obtain federal
42 finances to secure Title XIX matching funds for the p lan. The
43 federal waiver application shall seek Medicaid matching funds
44 for all general revenue, family contributions, and local
45 contributions.
46 (3) The agency shall adopt rules to implement and
47 administer this section.
48 Section 2. This act shall take effect July 1, 2024.
