1 A bill to be entitled
2 An act relating to competition for the sale of event
3 tickets; creating s. 542.345, F.S.; providing
4 legislative findings; defining the term "live
5 performance venue"; prohibiting live performance
6 venues from entering into specified contracts for the
7 sale of tickets or requiring artists to distribute
8 tickets through specific ticket platforms; specifying
9 that artists must be allowed to distribute tickets
10 through the use of the ticket platforms of the
11 performance artists' choice, subject to certain
12 conditions; prohibiting a live performance venue from
13 selling or transferring tickets at more than face
14 value; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Section 542.345, Florida Statutes, is created
19 to read:
20 542.345 Covenant not to compete for the sale or
21 distribution of event tickets and licenses prohibited.—
22 (1) The Legislature finds that sole source contracts for
23 the sale of tickets and licenses to events located at live
24 performance venues in Florida violate public policy and harm the
25 public good.

26 (2) For the purposes of this section, the term "live
27 performance venue" means a stadium, convention center,
28 exhibition hall, arena, coliseum, or auditorium which has
29 accepted within the previous 10 years any federal, state, or
30 local taxpayer funds for capital improvements or operational
31 expenses, including, but not limited to, funds collected
32 pursuant to a convention development tax imposed under s.
33 212.0305 and grants awarded under chapter 288.
34 (3) A live performance venue may not enter into a sole
35 source contract or covenant not to compete with a ticket selling
36 platform to sell or distribute tickets and licenses to events
37 located at the live performance venue.
38 (4) A performance artist who is contracted to perform at a
39 live performance venue may not be required to market, sell, or
40 distribute tickets to the event at which they are performing
41 through a specific ticket platform with which the live
42 performance venue has an exclusive contract.
43 (5) A live performance venue must allow performance
44 artists to market, sell, or distribute tickets to their
45 performances at the venue through the use of the ticket platform
46 of the performance artists' choice, subject to the same terms
47 and conditions as would apply to any other platform with which
48 the live performance venue has executed a contract for the same
49 or similar services within the past 2 years.
50 (6) A live performance venue may not distribute, sell, or

51 transfer any tickets or licenses for compensation at an amount
52 greater than the amount stated as the listed value of that
53 ticket or license.
54 Section 2. This act shall take effect July 1, 2024.
