1 A bill to be entitled
2 An act relating to termination of pregnancies;
3 amending s. 390.0111, F.S.; clarifying that certain
4 penalties relating to the unlawful termination of a
5 pregnancy do not apply to the pregnant woman who
6 terminates the pregnancy; providing effective dates.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. Paragraph (a) of subsection (10) of section
11 390.0111, Florida Statutes, is amended to read:
12 390.0111 Termination of pregnancies.—
13 (10) PENALTIES FOR VIOLATION.—Except as provided in
14 subsections (3), (7), and (12):
15 (a) Any person who willfully performs, or actively
16 participates in, a termination of pregnancy in violation of the
17 requirements of this section or s. 390.01112 commits a felony of
18 the third degree, punishable as provided in s. 775.082, s.
19 775.083, or s. 775.084. This paragraph does not apply to the
20 pregnant woman who terminates the pregnancy.
21 Section 2. Effective 30 days after any of the contingencies
22 described in section 9 of chapter 2023-21, Laws of Florida
23 occurring, paragraph (a) of subsection (10) of section 390.0111,
24 Florida Statutes, as amended by section 4 of chapter 2023-21,
25 Laws of Florida, is amended to read:
26 390.0111 Termination of pregnancies.—
27 (10) PENALTIES FOR VIOLATION.—Except as provided in
28 subsections (3), (7), and (12):
29 (a) Any person who willfully performs, or actively
30 participates in, a termination of pregnancy in violation of the
31 requirements of this section commits a felony of the third
32 degree, punishable as provided in s. 775.082, s. 775.083, or s.
33 775.084. This paragraph does not apply to the pregnant woman who
34 terminates the pregnancy.
35 Section 3. Except as otherwise expressly provided in this
36 act, this act shall take effect upon becoming a law.
