1 A bill to be entitled
2 An act relating to impact fee credits; amending s.
3 163.31801, F.S.; revising the area within which impact
4 fee credits are assignable or transferable; providing
5 an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1.âSubsection (10) of section 163.31801, Florida
10 Statutes, is amended to read:
11 163.31801âImpact fees; short title; intent; minimum
12 requirements; audits; challenges.â
13 (10)âImpact fee credits are assignable and transferable at
14 any time after establishment from one development or parcel to
15 any other that is within the same impact fee zone or impact fee
16 district or that is within an adjoining impact fee zone in the
17 same county or impact fee district within the same local
18 government jurisdiction and which receives benefits from the
19 improvement or contribution that generated the credits. This
20 subsection applies to all impact fee credits regardless of
21 whether the credits were established before or after June 4,
22 2021.
23 Section 2.âThis act shall take effect July 1, 2022.
