1 A bill to be entitled
2 An act relating to face covering mandates; amending s.
3 381.0016, F.S.; prohibiting counties and
4 municipalities from requiring that a citizen of the
5 United States wear a face covering; defining the term
6 “face covering”; providing that any such requirement
7 is void; creating s. 1001.4201, F.S.; prohibiting
8 district school boards from adopting, implementing, or
9 enforcing a policy, a rule, a code of conduct, or an
10 order requiring the wearing of a face covering;
11 defining the term “face covering”; providing that any
12 such policy, rule, code of conduct, or order is void;
13 creating s. 1001.5101, F.S.; prohibiting a district
14 school superintendent from implementing or enforcing a
15 policy, a rule, a code of conduct, or an order
16 requiring the wearing of a face covering; defining the
17 term “face covering”; providing that any such policy,
18 rule, code of conduct, or order is void; creating s.
19 1001.55, F.S.; prohibiting a school principal from
20 implementing or enforcing a policy, a rule, a code of
21 conduct, or an order requiring the wearing of a face
22 covering; defining the term “face covering”; providing
23 that any such policy, rule, code of conduct, or order
24 is void; providing an effective date.

26 Be It Enacted by the Legislature of the State of Florida:
27
28 Section 1. Section 381.0016, Florida Statutes, is amended
29 to read:
30 381.0016 County and municipal regulations and ordinances.
31 Any county or municipality may enact, in a manner prescribed by
32 law, health regulations and ordinances not inconsistent with
33 state public health laws and rules adopted by the department,
34 except that a county or municipality may not require that any
35 citizen of the United States wear a face covering. For purposes
36 of this section, the term “face covering” means any item
37 attached to a person’s face or head which is intended to slow or
38 prevent the transmission of any illness or disease, including,
39 but not limited to, personal protective equipment, respirators,
40 face shields, or cloth masks. Any such requirement is void.
41 Section 2. Section 1001.4201, Florida Statutes, is created
42 to read:
43 1001.4201 District school board; prohibited actions.—A
44 district school board may not adopt, implement, or enforce a
45 policy, a rule, a code of conduct, or an order that requires any
46 person to wear a face covering unless the policy is authorized
47 by a specific enabling statute that references this section. For
48 purposes of this section, the term “face covering” means any
49 item attached to a person’s face or head which is intended to
50 slow or prevent the transmission of any illness or disease,
51 including, but not limited to, personal protective equipment,
52 respirators, face shields, or cloth masks. Any such policy,
53 rule, code of conduct, or order is void.
54 Section 3. Section 1001.5101, Florida Statutes, is created
55 to read:
56 1001.5101 District school superintendent; prohibited
57 actions.—A district school superintendent may not implement or
58 enforce a policy, a rule, a code of conduct, or an order that
59 requires any person to wear a face covering unless the policy is
60 authorized by a specific enabling statute that references this
61 section. For purposes of this section, the term “face covering”
62 means any item attached to a person’s face or head which is
63 intended to slow or prevent the transmission of any illness or
64 disease, including, but not limited to, personal protective
65 equipment, respirators, face shields, or cloth masks. Any such
66 policy, rule, code of conduct, or order is void.
67 Section 4. Section 1001.55, Florida Statutes, is created to
68 read:
69 1001.55 School principals; prohibited actions.—A school
70 principal may not implement or enforce a policy, a rule, a code
71 of conduct, or an order that requires any person to wear a face
72 covering unless the policy is authorized by a specific enabling
73 statute that references this section. For purposes of this
74 section, the term “face covering” means any item attached to a

77 limited to, personal protective equipment, respirators, face
78 shields, or cloth masks. Any such policy, rule, code of conduct,
79 or order is void.
80 Section 5. This act shall take effect upon becoming a law.
