1 A bill to be entitled
2 An act relating to greenhouse gas emissions; creating
3 s. 403.08723, F.S.; defining the term “greenhouse
4 gas”; prohibiting the adoption or enforcement of
5 certain state and regional programs to regulate
6 greenhouse gas emissions without specific legislative
7 authorization; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 403.08723, Florida Statutes, is created
12 to read:
13 403.08723 Regulation of greenhouse gas emissions.—
14 (1) As used in this section, the term “greenhouse gas”
15 means carbon dioxide, methane, nitrous oxide, sulfur
16 hexafluoride, hydrofluorocarbon, and perfluorocarbon.
17 (2) Notwithstanding any other law, a state agency may not
18 adopt or enforce a state or regional program to regulate
19 greenhouse gas emissions for the purposes of addressing changes
20 in atmospheric temperature without specific legislative
21 authorization, including, but not limited to:
22 (a) State plans developed pursuant to 42 U.S.C. s. 7402, s.
23 7410, s. 7411, s. 7415, or s. 7545.
24 (b) Low carbon fuel standards.
25 (c) Plans or programs enabling regulation of mobile or
26 stationary sources, greenhouse gas taxes or fees, or greenhouse
27 gas trading.
28 (d) State or regional programs prompted by the
29 participation of the United States in international treaties or
30 executive agreements or interstate compacts or agreements.
31 Section 2. This act shall take effect July 1, 2022.
