2 Senate Joint Resolution
3 A joint resolution proposing the creation of Section
4 22 in Article III and a new section in Article XII of
5 the State Constitution to require a supermajority vote
6 of each house to approve a general law preempting a
7 subject of legislation to the state.

9 Be It Resolved by the Legislature of the State of Florida:

11 That the following creation of Section 22 in Article III
12 and a new section in Article XII of the State Constitution are
13 agreed to and shall be submitted to the electors of this state
14 for approval or rejection at the next general election or at an
15 earlier special election specifically authorized by law for that
16 purpose:
17 ARTICLE III
18 LEGISLATURE
19 SECTION 22.âPreemption to the state; supermajority vote
20 required.âThe legislature may not, except by a general law
21 passed by a two-thirds vote of each house, preempt to the state
22 a field of regulation or other subject of legislation not
23 preempted to it by this Constitution.
24 ARTICLE XII
25 SCHEDULE
26 Preemption to the state.âThis section and Section 22 of
27 Article III, which requires approval by a supermajority vote of
28 each house of the legislature for a general law that preempts a
29 subject of legislation to the state, shall take effect January
30 1, 2024.
31 BE IT FURTHER RESOLVED that the following statement be
32 placed on the ballot:
33 CONSTITUTIONAL AMENDMENT
34 ARTICLE III, SECTION 22
35 ARTICLE XII
36 SUPERMAJORITY VOTE FOR LEGISLATIVE PREEMPTION.âProposing an
37 amendment to the State Constitution, to take effect on January
38 1, 2024, to prohibit the Legislature from preempting to the
39 state any subject of legislation unless approved by a two-thirds
40 vote of each house.
