2 An act relating to rent control measures; amending ss.
3 125.0103, and 166.043, F.S.; removing provisions that
4 require local government measures that impose rent
5 controls to expire within a specified time period
6 unless they are extended or renewed in accordance with
7 law; conforming cross-references; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Subsections (4) through (7) of section
13 125.0103, Florida Statutes are renumbered as subsections (3)
14 through (6), respectively, and present subsections (3) and (6)
15 of that section are amended, to read:
16 125.0103 Ordinances and rules imposing price controls;
17 findings required; procedures.—
18 (3) Any law, ordinance, rule, or other measure which has
19 the effect of imposing controls on rents shall terminate and
20 expire within 1 year and shall not be extended or renewed except
21 by the adoption of a new measure meeting all the requirements of
22 this section.
23 (5)(6) In any court action brought to challenge the
24 validity of rent control imposed pursuant to the provisions of
25 this section, the evidentiary effect of any findings or

26 recitations required by subsection (4)(5) shall be limited to
27 imposing upon any party challenging the validity of such measure
28 the burden of going forward with the evidence, and the burden of
29 proof (that is, the risk of nonpersuasion) shall rest upon any
30 party seeking to have the measure upheld.
31 Section 2. Subsections (4) through (7) of section 166.043,
32 Florida Statutes are renumbered as subsections (3) through (6),
33 respectively, and present subsections (3) and (6) of that
34 section are amended, to read:
35 166.043 Ordinances and rules imposing price controls;
36 findings required; procedures.—
37 (3) Any law, ordinance, rule, or other measure which has
38 the effect of imposing controls on rents shall terminate and

40 by the adoption of a new measure meeting all the requirements of
41 this section.
42 (5)(6) In any court action brought to challenge the

50 Section 3. This act shall take effect July 1, 2022.
