The Restoration of Covenanted Roads and Alleys by the District Government Clarification Emergency Amendment Act of 2026 amends the existing law to clarify the authority of the District government to repair or restore certain private rights-of-way for the passage of motor vehicles used by the District. The bill specifies that the Mayor can undertake repairs if the private right-of-way is utilized for regular trash removal services, is not in good repair, and the owner has not covenanted to maintain it. Additionally, the owner must consent to the repairs and provide a release of liability and indemnification.

The bill also includes amendments to existing language, such as changing the reference from "this section" to "subsection (a) of this section" and removing the phrase "and impose such other conditions as the Mayor deems appropriate" from a paragraph. New subsections are added that outline the conditions under which the Mayor may repair or restore private rights-of-way, including the requirement to obtain releases of liability from property owners likely to be impacted by the repairs. The act is set to take effect upon approval by the Mayor and will remain in effect for no longer than 90 days.
