The proposed resolution, known as the Personal Delivery Device Weight Limit Emergency Declaration Resolution of 2026, aims to address the urgent need to amend the Personal Delivery Device Act of 2018 by increasing the weight limit for personal delivery devices (PDDs). Currently, the law permits PDDs to operate at a maximum weight of 90 pounds, which has become a barrier to the introduction of newer models that exceed this limit and offer enhanced features. The resolution highlights that many other states have already adopted higher weight limits for PDDs, with some allowing devices to weigh up to 500 pounds or having no weight limit at all.
To prevent a legal gap following the expiration of temporary legislation that allowed for heavier PDDs, the Council is seeking to enact this emergency resolution. The Council previously passed both an emergency and a temporary amendment to allow PDDs weighing up to 275 pounds, but these measures are set to expire soon. The resolution emphasizes the necessity of immediate action to ensure the continued operation and deployment of advanced PDDs in the District of Columbia while a permanent bill is being considered.
