The Special Education for Young Adults in the Custody of the Department of Corrections Congressional Review Emergency Amendment Act of 2025 amends existing laws to designate the Department of Corrections as the agency responsible for providing a free appropriate public education (FAPE) to individuals with disabilities who are in its custody and detained in secure facilities. Specifically, the bill introduces a new requirement for the Department to ensure that these individuals, aged 18 and older, receive FAPE during the school year 2024-2025, in accordance with the Individuals with Disabilities Education Act (IDEA) and District law.

The bill also makes several amendments to existing legal language, including the restructuring of paragraphs within the relevant sections of the law. Notably, it adds a new paragraph (12) to the Department of Corrections Act and a new paragraph (14) to the Corrections Oversight Improvement Omnibus Amendment Act of 2022, both of which outline the obligation to provide educational services to eligible individuals in custody. The act is set to take effect following approval by the Mayor and will remain in effect for no longer than 90 days.
