The Second Chance Clarification Emergency Amendment Act of 2025 amends section 16-805(c)(1) of the District of Columbia Official Code to clarify the timeline for the automatic sealing of nonconvictions. Specifically, it modifies subparagraph (A) to replace the phrase "prior to the effective date of the Second Chance Amendment Act of 2022" with "on or before September 30, 2027." Additionally, subparagraph (B) is amended to change the language from "the effective date of the Second Chance Amendment Act of 2022, on 2nd reading on December 20, 2022, shall be sealed" to "October 1, 2027, shall be sealed by October 1, 2027."
This act is set to apply as of March 1, 2025, and will take effect following approval by the Mayor or, if vetoed, upon the Council's override of that veto. The act is designed to remain in effect for no longer than 90 days, in accordance with the emergency provisions outlined in the District of Columbia Home Rule Act.
