The Second Chance Clarification Temporary Amendment Act of 2025 amends section 16-805(c)(1) of the District of Columbia Official Code to clarify the timeline for the automatic sealing of nonconvictions. Specifically, it modifies subparagraph (A) to replace the phrase "prior to the effective date of the Second Chance Amendment Act of 2022" with "on or before September 30, 2027." Additionally, subparagraph (B) is amended to change the language from "the effective date of the Second Chance Amendment Act of 2022, on 2nd reading on December 20, 2022, shall be sealed" to "October 1, 2027, shall be sealed by October 1, 2027."
The act is set to apply as of March 1, 2025, and will take effect following approval by the Mayor, or if vetoed, after the Council overrides the veto, along with a 30-day congressional review period. The act is temporary and will expire 225 days after it takes effect.
