Mayor Muriel Bowser has requested the Council of the District of Columbia to reprogram $4,000,000 from the H Street Bridge project to fund the Rehabilitation of the Key Bridge Over the Potomac River. This reallocation is necessary to fulfill a legal settlement agreement with Technopref Industries, Inc., totaling $6,500,000, which arose from claims related to delays and modifications in the Key Bridge project. The settlement will be partially funded by $2,500,000 in federal funds, while the remaining $4,000,000 will come from the H Street Bridge project, which has available funds due to budget reprioritization by the District Department of Transportation (DDOT). The reprogramming is compliant with the Reprogramming Policy Act of 1980 and is expected to have no adverse impact on DDOT's budget or the District's financial plan.

The resolution emphasizes the urgency of this request, as the settlement payment must be made by February 28, 2025, to avoid breaching the agreement. DDOT has committed to replenishing the reprogrammed funds in a future year within the Capital Improvement Plan (CIP). The Office of the Chief Financial Officer has reviewed the request and raised no objections, confirming that the reprogramming will not negatively affect ongoing projects or services. The resolution also notes that any delays in this action could jeopardize the District's ability to meet the settlement requirements, but reassures that there will be no anticipated negative impact on other programs or services as a result of this reallocation.
