The Department of Energy and Environment Rulemaking Clarification Congressional Review Emergency Amendment Act of 2025 amends the District Department of the Environment Establishment Act of 2005. The bill clarifies that the Mayor may promulgate rules and regulations to implement the provisions of the Act, rather than being required to do so. Additionally, it eliminates the previous requirement that all rules and regulations be submitted to the Council for a 45-day active review period.

Specifically, the bill modifies Section 110 of the Act by changing the phrase "Mayor shall promulgate" to "Mayor may promulgate," thereby granting the Mayor more discretion in rulemaking. Furthermore, it repeals subsection (b), which contained the requirement for Council review. The act is set to apply retroactively from July 29, 2021, and will remain in effect for no longer than 90 days following approval by the Mayor or a Council override of a potential veto.
