204.51), enclosed for consideration and approval by the Council of the District of Columbia is
proposed Contract No. 2024-92 with BCP II LLC in the amountof $42,957,979.
Under the proposed contract, the District will loan $42,957,979 from the Housing Production Trust
Fund to BCP II LLC, which will use the proceeds of the loan to finance certain eligible
predevelopment costs, soft costs, and construction hard costs for 229 unitsofaffordable housing
located at 4386 7th Street SE, 4283 Bamaby Road SE, and 4201 7th Street SE in Ward 8.

DHCD received a request for funding from the borrower to be used for the purpose of
financing certain eligible predevelopment costs, soft costs andconstruction hard costs

(D) The background and qualifications of the proposed contractor,
including its organization, financial stability, personnel, and prior
performance on contracts with the District government:
The Seller, Belmont Crossing Partners LLC, was formed for the purpose of developing the
Belmont Crossing multifamily development in three phases. Owners of Belmont Crossing
Partners include of Housing Help Plus, MED, Gilbane Development Company and EquityPlus
Manager. All entities involved in the proposed contractor have satisfactory prior performance
on contracts with the District government.
(E) Performance standards and the expected outcome of the proposed contract:
The developers of Belmont Crossing have requested $42,957,979 in HPTF development
financing for the production of 229 units across four different buildings in Ward 8 in the
Washington Highlands neighborhood.
(F) A certification that the proposed contract is within the appropriated
budget authority for the agency for the fiscal year and is consistent with
the financial plan and budget adopted in accordance with D.C. Official
Code §§ 47-392.01 and 47-392.02:
The loan will be funded through the Housing Production Trust Fund. Attached is the
certification that the development finance is consistent with the District’s financial
plan and budget.
(G) A certification that the proposed contract is legally sufficient, including
whether the proposed contractor has any currently pending legal
claims against the District:
A legal sufficiency memorandum from the Office of the General Counsel is attached.
(H) A certification that the proposed contractor is current with its
District and federal taxes or has worked out and is current with a
payment schedule approved by the District or federal government:
District and federal tax law compliance certifications are attached.

Dear Commissioner Williams,
Pursuant to D.C. Official Code § 1-309.10 (2001 ed.), you are hereby informed that the
Department of Housing and Community Development (“Department” or “the Department”) will
enter into a sale/leaseback agreement with Belmont Crossing Partners LLC for the purpose of
facilitating developmentof229 units of affordable housing locatedin Square 6208in Washington,
D.C., at (i) Lot 110, with an addressof 4386 7" St. Lot 111 with an address of 4283 Barnaby Rd.
SE; (iii) Lot [113] with an addressof [4201] 7" St. SE, and (iv) Lot [114] with an addressof [4201]ta St.
SE. The purchase will be made with fundingin an approximate amountof $16,300,000 from the
Housing Production Trust Fund (HPTF). Prior to construction start, the property will be leased
to BPC Il, LLC, a single-purpose affiliateofthe seller which will own and operate the housing
project, for 99 years.
‘A separate loan of approximately $42,357,979 in HPTF funds will be provided to finance
construction and related costs for the affordable housing project. The project will contain 70
units affordable to households earning up to 30% of Median Family Income (MFI), 113 units
affordable to households earning 50% of MFI, and 46 units affordable to households earning
80%of MFI. One hundred five (105) houscholds relocated from the buildings that will be razed
and replaced by new apartments will have the right to return.
Please be advised that Advisory Neighborhood Commission 8E has thirty (30) business days
from the date of this notice to submit comments on the proposed sale/leaseback agreement. At
6:30pm on Tuesday, September 24, DHCD will conduct a public hearing to provide information
and accept comments on the ground lease to BPC I LLC. This hearing will be conducted in a
virtual manner (see Zoom information below). District law requires that the Department give
“great weight” to all relevant ANC concerns or recommendations, We respectfully request that
any comment in response waive the remainder of the statutory 30 day ANC notice comment
period.
‘The Department must receive comments by 5:00pm EST on September 25, 2024 (after the
thirty-business day comment period and the public hearing). You must include a reference to the

SUBJECT: Proposed Loan Contract for an acquisition and construction loan in the
Amount not to exceed Forty Two Million Nine Hundred Fifty Seven Thousand Nine
Hundred Seventy Nine and 00/100 Dollars ($42,957,979.00) between the Department of
Housing and Community Development (“DHCD” or “Lender”) and Belmont Crossing
Partners LLC, (“Borrower”) for the purpose of financing eligible acquisition and
construction hard costs to provide 229 units of affordable housing located at 4273
Barnaby Road, 4283 Barnaby Road, 4225 7th Street, and 4233 7th Street, SE, Washington
D.C. (“the Project”)
DHCD proposes to enter into the above subject transaction to finance eligible acquisition
and construction hard costs, producing 229 units of affordable housing for District
residents at the above subject addresses.
DHCD proposes to provide the loan financing pursuant to the authority under the Housing
Production Trust Fund Act of 1988, D.C. Official Code §42-2801 et seq. and the District of
Columbia Municipal Regulations, Title 10B, Chapter 41 (collectively, the “HPTF
Statutes” or the “HPTF Regulations”).
