A RESOLUTION

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency, due to congressional review, with respect to the need
to amend the Construction Codes Approval and Amendments Act of 1986 to require a
property owner, contractor, or person applying for specific permits for construction work
to demonstrate that hist or her insurance will insure adjacent property owners for loss or
damage that arises out of the proposed construction work.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Protecting Adjacent and Adjoining Property Owners from
Construction Damage Second Congressional Review Emergency Declaration Resolution of
2024”.
Sec. 2. (a) On February 1, 2024, the Council unanimously approved the Protecting
Adjacent and Adjoining Property Owners from Construction Damage Temporary Amendment
Act of 2024, effective April 10, 2024 (D.C. Law 25-155; 71 DCR 2091)(“Temporary Act”). The
Temporary Act expires on November 21, 2024.
(b) On October 1, 2024, the Council unanimously approved the Protecting Adjacent and
Adjoining Property Owners from Construction Damage Amendment Act of 2024, enacted on
October 24, 2024 (D.C. Act 25-598; 71 DCR 12990)(“Permanent Act”) on second reading.
(c) The Permanent Act was signed by the Mayor on October 24, 2024. It must now
complete a 30-day congressional review period before it becomes effective. Therefore, this
congressional review emergency is necessary to prevent a gap in the law between the expiration
of the Temporary Act and the effective date of the Permanent Act.
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Protecting Adjacent and Adjoining
Property Owners from Construction Damage Second Congressional Review Emergency
Amendment Act of 2024 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
