To declare the existence of an emergency, due to congressional review, with respect to the need
to require that tax abatements for housing in downtown be awarded competitively, ensure
proper recording of the Tenant Opportunity to Purchase Act exemption, extend the
timeframe for receiving a certificate of occupancy, and remove a calculation that is no
longer applicable.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Housing in Downtown Tax Abatement Congressional Review
Emergency Declaration Resolution of 2024”.
Sec. 2. (a) There existed an immediate need to require that tax abatements for housing in
downtown be awarded competitively, ensure proper recording of the Tenant Opportunity to
Purchase Act exemption, extend the timeframe for receiving a certificate of occupancy, and
remove a calculation that is no longer applicable.
(b) In January 2024, the Council enacted the Housing in Downtown Tax Abatement
Technical Emergency Amendment Act of 2024, effective February 1, 2024 (D.C. Act 25-386; 71
DCR 1460), (“emergency legislation”) and the Housing in Downtown Tax Abatement Technical
Temporary Amendment Act of 2024, passed on 2nd reading on February 6, 2024 (D.C. Act 25-
399; 71 DCR 2093) (“temporary legislation”) to address the above-mentioned issues.
(c) The temporary legislation expires on November 21, 2024. The permanent legislation
was passed by Council and signed by the Mayor on October 31 , 2024 (D.C. Act 25-617)
(“permanent legislation”), but must still complete the 30-day review period required by section
602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat.
813; D.C. Official Code § 1-206.02(c)(1)), and will not become law until after the temporary
legislation has expired.
(d) It is necessary that the provisions of the emergency and temporary legislation
continue in effect, without interruption, until the permanent legislation is in effect.
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that Housing in Downtown Tax Abatement
Congressional Review Emergency Amendment Act of 2024 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
