A PROPOSED RESOLUTION

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

1 To declare the existence of an emergency with respect to the need to amend the Retail Incentive
2 Act of 2004 to modify the boundaries of the Ward 4 Georgia Avenue Retail Priority
3 Area; and to amend the Fiscal Year 2025 Budget Support Act of 2024 to make a technical
4 correction with regard to a grant to the National Cherry Blossom Festival.

6 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
7 resolution may be cited as the “Park View and Pleasant Plains Retail Priority Area and Grant
8 Clarification Emergency Declaration Resolution of 2024”.
9 Sec. 2. (a) The boundary of the Ward 4 Georgia Avenue Retail Priority Area, as defined
10 in section 4(o) of the Retail Incentive Act of 2004, effective September 8, 2004 (D.C. Law 15-
11 185; D.C. Official Code § 2-1217.73(o)), erroneously excludes certain blocks that are intended to
12 be included in the Georgia Avenue corridor. Additionally, the boundary leaves a gap that omits
13 small businesses on Sherman Avenue, N.W., and Warder Street, N.W., immediately parallel to
14 Georgia Avenue, from the bounds of the Priority Area. Finally, the metes and bounds
15 establishing the boundary erroneously refer to Kenyon Street, N.W. as “Kenyon Avenue, N.W.”.
16 (c) Emergency legislation is necessary to ensure that the language establishing the Ward
17 4 Georgia Avenue Retail Priority Area boundary is corrected, in order for the Great Streets
18 grants associated with the boundaries to be properly administered in Fiscal Year 2025.

19 (d) A typographical error exists in the Fiscal Year 2025 Budget Support Act with regard
20 to a grant to the National Cherry Blossom Festival. $1.5 million is budgeted for the grant,
21 however the BSA language only authorizes EventsDC to transfer $1 million. A correction is
22 needed to align the BSA language with the funding allocated for the festival grant.
23 Sec. 3. The Council of the District of Columbia determines that the circumstances in
24 section 2 constitute emergency circumstances, making it necessary that the Park View and
25 Pleasant Plains Retail Priority Area and Grant Clarification Emergency Amendment Act of 2024
26 be adopted after a single reading.
27 Sec. 4. This resolution shall take effect immediately.
