                                        October 1, 2024

To declare the existence of an emergency with respect to the need to approve Modification Nos.

       4 and 5 to Contract No. CW104540 with the Washington Humane Society d/b/a Humane

       Rescue Alliance, and to authorize payment for the goods and services to be received

       under the contract.

        RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

resolution may be cited as the “Modification Nos. 4 and 5 to Contract No. CW104540 with the

Washington Humane Society d/b/a Humane Rescue Alliance Approval and Payment

Authorization Emergency Declaration Resolution of 2024”.

        Sec. 2. (a) There exists an immediate need to approve Modification Nos. 4 and 5 to

Contract No. CW104540 with the Washington Humane Society, d/b/a Humane Rescue Alliance,

and to authorize payment for the goods and services to be received under the contract.

        (b) On March 25, 2023, the Office of Contracting and Procurement (“OCP”), on behalf of

the Department of Health (“DOH”), executed Contract No. CW104540 with the Washington

Humane Society, d/b/a Humane Rescue Alliance, to provide comprehensive animal control,

disease prevention, and shelter services to DOH in the not-to-exceed amount of $3,441,342 for

the period April 1, 2023 through September 30, 2023.

        (c) Modification No. 4, dated August 7, 2024, which, among other changes, added an

option year 2 to the contract.

        (d) Modification No. 5 is now necessary to exercise option year 2 in the not-to-exceed

amount of $2,044,191 for the period October 1, 2024 through December 31, 2024.

        (e) Council approval is necessary because the modifications will increase the value of the

contract by more than $1 million during a 12-month period.

        (f) Without Council approval, Washington Humane Society, d/b/a Humane Rescue

Alliance, cannot be paid for goods and services provided in excess of $1 million for the period

October 1, 2024 through December 31, 2024.

      Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute

emergency circumstances making it necessary that the Modification Nos. 4 and 5 to Contract No.

Payment Authorization Emergency Act of 2024 be adopted after a single reading.

      Sec. 4. This resolution shall take effect immediately.
