9 To declare the existence of an emergency, due to expiring temporary legislation, with respect to
10 the need to reduce the building restriction line along the southern side of Fern Street, NW
11 on Lots 847, 973, 1016 to 1033, and 1062 to 1072 in Square 2950 from 15 feet to 9.5
12 feet.

14 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution
15 may be cited as the “Adjustment of Building Restriction Line in Square 2950 along the southern
16 side of Fern Street NW, S.R. 23-06301 Emergency Declaration Resolution of 2024”.
17 Sec. 2. (a) On December 9, 2023, the Council approved the Adjustment of Building
18 Restriction Line in Square 2950 along the southern side of Fern Street NW, S.R. 23-06301
19 Temporary Act of 2023, effective March 1, 2024 (D.C. Act 25-0357; 71 DCR 2679) (“temporary
20 measure”). The temporary measure is set to expire on October 12, 2024.
21 (b) The Adjustment of Building Restriction Line in Square 2950 along the southern side
22 of Fern Street NW, S.R. 23-06301 Act of 2023 (B25-0611) was approved by the Council on first
23 reading at the July 9, 2024 legislative meeting. Because the permanent measure must undergo
24 congressional review, it will not be in effect before the temporary measure expires.
25 (c) This emergency is necessary to prevent a gap in the law between the expiration of the
26 temporary measure and effective date of the permanent measure

27 Sec. 3. The Council of the District of Columbia determines that the circumstances
28 enumerated in section 2 constitute emergency circumstances making it necessary that
29 Adjustment of Building Restriction Line in Square 2950 along the southern side of Fern Street
30 NW, S.R. 23-06301 Emergency Declaration Resolution of 2024 be adopted after a single
31 reading.
32 Sec. 4. This resolution shall take effect immediately.
