Pursuant to section 451 of the District of Columbia Home Rule Act (D.C. Official Code § 1-
204.51) and section 202of the Procurement Practices Reform Act of 2010 (D.C. Official Code §
2-352.02), enclosed for consideration and approval by the Councilofthe District of Columbia is
proposed Modification No. M04 to Contract No. DCAM-23-NC-RFP-0009G with Superior
Services & Associates, Inc., to exercise option year two in the not-to-exceed amount of
$1,735,972. The period of performance is from October 1, 2024, through September 30, 2025.
Under the proposed modification, Superior Services & Associates, Inc. will continue to provide
comprehensive janitorial and related supplemental services.

recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):

The Office of the Chief Financial Officer has acknowledged that proposed Modification No. M04
is within the appropriated budget authority for the agency for the fiscal year FY25 and is consistent
with the financial plan and budget adopted in accordance with D.C. Official Code §§ 47-392.01
and 47-392.02. The applicable Fiscal Sufficiency certification accompanies this Council Package.
(E) (1) A certification that the proposed contractor has been determined not to be in violation of
section 334a of the Board of Ethics and Government Accountability Establishment and
Comprehensive Ethics Reform Amendment Act of 2011, D.C. Official Code § 1-1163.34a;
and (2) A certification from the proposed contractor that it currently is not and will not be

The proposed Modification No. 04 to the Contract for City-Wide Comprehensive Janitorial and
Related Supplemental Services (thereafter, the “Services”) with Superior Services & Associates,
Inc. (the “Contractor”) has a Not-to-Exceed (“NTE) value of $1,735,972.00 for Fiscal Year 2025
(a total NTE of $1,485,972.00 for basic services and a $250,000.00 ordering ceiling for cost
reimbursable, supplemental services). The Contractor will provide the Services covering a period
from October 1, 2024 through September 30, 2025.
As the Agency Fiscal Officer of the Department, I hereby acknowledge that the Mayor’s Proposed
Fiscal Year 2025 Budget for the Department includes funds for the proposed modification to the
Contract with Superior Services & Associates, Inc. in the amount of $1,735,972.00.
However, I am unable to certify these funds until final approval of the District’s FY 2025 Budget
and Financial Plan.

1 . In accordance with Section F.2 Option To Extend The Term of the Contract, the District hereby fully exercises Option Year Two (OY2). The
Contract Period of Performance is October 1, 2024 through September 30, 2025.
2. CONTRACT RECAP: The Total Firm-Fixed, Fully Loaded Pnce for Monthly Basic Services is $1 ,485,972 .00 The aggregate non-guaranteed
NTE for the Cost Reimbursement, Supplemental Serv,ces Component is $250,000.00. In accordance with the Contract CUN Summary
incorporated hereto as Exhibit A . the Total Contract Not-to-Exceed Value for alt services during OY2 both basic and supplemental is
$1,735,972.00.
3. The US Department of Labor Wage Determination Schedule N o 201 5-42 82 Rev No. 30 dated July 22, 2 02 4 is hereby incorporated as Exhibit B to
Modification No M04 The Contractor agrees and acknowledges that it shall be in comp!iance with the most current requirements of the U S
Depa11ment of Labor wage Determination Schedule which 1 s applicable on the effective date o f the mooification. Thus, the Contractor agrees ano
acknowledges that the most current requirements of the US Depal1ment of Labor Wage Determination Schedule shall be incorporated into the
Contract.
4. The Contractor agrees and acknowledges that ii shall be in compliance with the most current requirements of the District of Columbia Living Wage
Act of 2006, D.C Official Code §§ 2-220. 0 1 - 2-220 .1 1 , that are applicable on the effective date of the Contract modification Exhibit C . Thus, the
Co ntractor agrees and acknowledges that the most current requirements of the Living Wage Act of 2006 shall be incorporated into the Contract.
5. All other Terms and Conditions of Contract DCAM-23-NC-RFP-0009G remain u nchanged.
6. RELEASE: It is mutually agreed that in exchange for this Modification and other consideration, the Contractor hereby releases, waives, settles, and
holds the Depal1ment harmless from any and all actual or potential claims or demands for delays, disruptions, additional work, additional time,
additional costs, contract extensions, compensation, or liability u nder any theory, whether known or unknown, that the Contractor may have now or
in the future against the Department arising from or out of, as a consequences or result of, relating to or in any manner connected with this
Modification, the above-referenced Seivices, and the work provided pursuant to the Agreement.
