To declare the existence of an emergency with respect to the need to define the terms non-
District resident and another jurisdiction, and to provide the Alcoholic Beverage and
Cannabis Board with the authority to issue patient and caregiver registration cards at no
cost.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Medical Cannabis Patient Access Clarification Emergency
Declaration Resolution of 2024”.
Sec. 2. (a) There existed an immediate need to define the terms non-District resident and
another jurisdiction, and to provide the Alcoholic Beverage and Cannabis Board with the
authority to issue patient and caregiver registration cards at no cost.
(b) In October 2023, the Council enacted legislation to address the above-mentioned
issues. The temporary, the Medical Cannabis Patient Access Clarification Temporary
Amendment Act of 2023, effective January 23, 2024 (D.C. Law 25-103; 71 DCR 1651)
(“temporary act”), expires on September 4, 2024.
(c) Comprehensive permanent legislation addressing these issues has been introduced but
must complete the legislative process.
(d) It is of vital importance that the provisions of the temporary act continue in effect
until the permanent legislation has become law.
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Medical Cannabis Patient Access
Clarification Emergency Amendment Act of 2024 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
