To declare the existence of an emergency with respect to the need to approve Modification Nos.

       7, 8, and 10 to Contract No. DCAM-20-CS-RFP-0020 with GCS, Inc. to provide

       construction management at-risk services for Stead Park Recreation Center, and to

       authorize payment for the goods and services received and to be received under the

       contract.

        RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

resolution may be cited as “Modification Nos. 7, 8, and 10 to Contract No. DCAM-20-CS-RFP-

0020 with GCS, Inc., Approval and Payment Authorization Emergency Declaration Resolution

of 2024”.

        Sec. 2. (a) There exists an immediate need to approve Modification Nos. 7, 8, and 10 to

Contract No. DCAM-20-CS-RFP-0020 with GCS, Inc. to provide construction management at-

risk services for Stead Park Recreation Center and to authorize payment for the goods and

services received and to be received under the contract.

        (b) By Modification No. 7, dated September 26, 2023, the Department of General

Services (“DGS”) increased the guaranteed maximum price (“GMP”) of the contract by

$698,313, from $14,503,370 to $15,201,683.

        (c) By Modification No. 8, dated November 3, 2023, DGS increased the GMP of the

contract by $100,000 to $15,301,683.

        (d) Modification No. 10 is to cover the costs of replacing the existing syntactic turf

athletic field and the replacement of the running track that surrounds the athletic field and will

increase the GMP of the contract by $499,570, to $15,801,253.

        (e) Council approval is necessary because the modifications will increase the value of the

contract by more than $1 million during a 12-month period.

        (f) Approval is necessary to allow for the continuation of these vital services. Without

this approval, GCS, Inc. cannot be paid for goods and services provided in excess of $1 million.

       Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute

emergency circumstances making it necessary that the Modification Nos. 7, 8, and 10 to Contract

No. DCAM-20-CS-RFP-0020 with GCS, Inc., Approval and Payment Authorization Emergency

Act of 2024 be adopted after a single reading.

       Sec. 4. This resolution shall take effect immediately.
