Enclosed for consideration and enactment by the Council of the District of Columbia is proposed
resolution, the “Multiyear Contract No. CW108413 with Acme Auto Leasing, LLC Emergency
Approval Resolution of 2024,” and accompanying emergency declaration resolution to approve
multiyear Contract No. CW108413 with Acme Auto Leasing, LLC.
Under the contract, Acme Auto Leasing, LLC will lease vehicles to the District. The not-to-exceed
price for the term of this multiyear contract with Acme Auto Leasing, LLC is $9,690,700 for the
three-year period of performance.

(B) For a contract containing option periods, the contract amount for the base period and for each
option period. If the contract amount for one or more of the option periods differs from the
amount for the base period, provide an explanation of the reason for the difference:
Base Period Amount: $9,690,700 (3-year base period)
Option Period One Amount: $1,445,164
Explanation of difference from base period (if applicable): The rates per vehicle decrease over
time and the option period covers 12-month period only.

(C) The goods or services to be provided, the methods of delivering goods or services, and any
significant program changes reflected in the proposed contract:

The DC Department of Public Works (DPW) requires a leasing contractor to provide vehicles to meet
the needs of DC’s user agencies. The vehicles leased to the District shall consist of light and medium
vehicles ranging from sedans, vans and pick-up trucks. Under this proposed contract, Acme shall
provide vans and pick-up trucks.
(D) The selection process, including the number of offerors, the evaluation criteria, and the
evaluation results, including price, technical or quality, and past performance components:
Invitation for Bids (IFB) No. Doc652571 was issued in the District’s E-sourcing system on July 27,
2023 on the open market. The IFB is subsequently posted in the newspaper on July 28, 2023. The
District intends to award a single contract per aggregate group of vehicles resulting from the
solicitation to the responsive and responsible bidder/s who has/have the lowest evaluated bid/s. On
the closing date, August 15, 2023, four bidders responded to the IFB. After reviewing their bids, one
vendor was deemed non-responsive for failing to submit a bid on all Contract Line Item Numbers
(CLIN) and for failing to identify their proposed vehicle for each CLIN.
The three remaining bids were deemed responsive and after tabulating the bids, Acme was the lowest
bidder for Groups 2 (vans) and 3 (pickup trucks) while another vendor was the lowest bidder for
Group 1 (sedans). Acme has provided satisfactory performance in meeting the District requirements
for vehicle leasing under past contracts CW15832 and CW50424.
(E) A description of any bid protest related to the award of the contract, including whether the
protest was resolved through litigation, withdrawal of the protest by the protestor, or voluntary
corrective action by the District. Include the identity of the protestor, the grounds alleged in
the protest, and any deficiencies identified by the District as a result of the protest:

(F) The background and qualifications of the proposed contractor, including its organization,
financial stability, personnel, and performance on past or current government or private sector
contracts with requirements similar to those of the proposed contract:
Since 1995, Acme has been providing fleet leasing solutions and fleet management services to
federal, state/local government and private corporations across the United States. Acme with their
40 employees currently holds a GSA Schedule contract and has been leasing vehicles to the District
for almost 20 years. Acme has a satisfactory record of performance. Their D&B Report dated
October 11, 2023 indicated “Low Risk” ratings for Supplier Stability Indicator and Supplier
Evaluation Risk. The company reported annual sales of $10.6M.
(G) A summary of the subcontracting plan required under section 2346 of the Small, Local, and
Disadvantaged Business Enterprise Development and Assistance Act of 2005, as amended, D.C.
Official Code § 2-218.01 et seq. (“Act”), including a certification that the subcontracting plan
meets the minimum requirements of the Act and the dollar volume of the portion of the contract
to be subcontracted, expressed both in total dollars and as a percentage of the total contract
amount:

On June 29, 2023, DSLBD approved OCP’s waiver request, WR-4648, for the subcontracting
requirements in solicitation no. Doc652571. The waiver was modified by DSLBD on October 26,
2023 to conform the amount to the successful bidder’s price; the percentage waived remained
unchanged.
(H) Performance standards and the expected outcome of the proposed contract:
The contractor is expected to make delivery within 60 – 90 days after receipt of DPW’s Lease Order
Worksheet.
(I) The amount and date of any expenditure of funds by the District pursuant to the contract prior
to its submission to the Council for approval:
As of this date, there is no expenditure of funds by the District.
(J) A certification that the proposed contract is within the appropriated budget authority for the
agency for the fiscal year and is consistent with the financial plan and budget adopted in
accordance with D.C. Official Code §§ 47-392.01 and 47-392.02:
The Agency Financial Officer has certified that sufficient funding is available for FY24 of the
proposed multiyear contract and that funds for FY25, FY26 and FY27 will be requested in the agency
budgets for those years and are contingent upon Congressional approval of those budgets.
(K) A certification that the contract is legally sufficient, including whether the proposed contractor
has any pending legal claims against the District:
The contract action has been determined to be legally sufficient and the proposed contractor has no
pending legal claims against the District.
(L) A certification that Citywide Clean Hands database indicates that the proposed contractor is
current with its District taxes. If the Citywide Clean Hands Database indicates that the
proposed contractor is not current with its District taxes, either: (1) a certification that the
contractor has worked out and is current with a payment schedule approved by the District; or
(2) a certification that the contractor will be current with its District taxes after the District
recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):
A certification has been issued by the Citywide Clean Hands database which indicates that the
proposed contractor is current with its District taxes.
(M) A certification from the proposed contractor that it is current with its federal taxes, or has
worked out and is current with a payment schedule approved by the federal government:
The proposed contractor self-certified that they are current with federal taxes.

(N) The status of the proposed contractor as a certified local, small, or disadvantaged business
enterprise as defined in the Small, Local, and Disadvantaged Business Enterprise Development
