Dear Chairman Mendelson:
Enclosed for consideration and approval by the Council of the District of Columbia is a
proposed modification to Contract No. DCPL-2022-C-0018 with Turner Construction
Company for $5,500,000, which includes an Owner’s Allowance of $593,933. This
proposed modification funds the Pre-Construction Services for the New Library in
Congress Heights. The contract period of performance will be from the date of award
through December 31, 2025. After design completion and upon approval of the GMP,
DCPL will submit a Phase 2 Construction Services modification to the Council for
approval.

(C) The goods or services to be provided, the methods of delivering goods or services,
and any significant program changes reflected in the proposed contract:
The contract is for Design-Build Services for the new Library in Congress Heights
based on the approved plans and specifications. In accordance with the contract, the
project will be delivered in two (2) phases: Phase 1 – Design and Preconstruction
Services included collaboration with DC Public Library (DCPL) staff and the Design
Team through completion of the construction documents including preparation of the
cost estimate and project schedule; and Phase 2 - Construction Services consisted of
management of the trade bidding process including establishment of the Guaranteed
Maximum Price (GMP).

(D) The selection process, including the number of offerors, the evaluation criteria,
and the evaluation results, including price, technical or quality, and past
performance components:
On November 23, 2021, DCPL issued a Request for Qualifications (RFQ) for a
Contractor to provide all due diligence, design, library building planning, pre-
construction and construction services for the new Library in Congress Heights to
replace Parklands-Turner Library project as part of a 2-Step source selection process:
Step 1 – Request for Qualifications and Step 2 – Request for Proposals (RFP).
The RFP was issued in the open market with a 35% set-aside subcontracting
requirement for Offerors based on their status as a Certified Business Enterprise
(CBE) as determined by the District of Columbia Department of Small and Local
Business Development.
There were five (5) Amendments issued during the solicitation (A01), issued February
28, 2022, which provided responses to Offerors’ questions. On the RFP submission
deadline of March 31, 2022, five (5) proposals were received in response to the
solicitation.
Step 1 Evaluations
Proposals were distributed to the Technical Evaluation Panel (TEP) on January 11,
2022. The TEP began evaluating the proposals on January 11, 2022.
At the conclusion of the initial consensus meeting, the TEP agreed on the following
technical scores for the ten (10) Offerors. The below table summarizes the outcome
of TEP scoring.

Based on TEP scoring it was determined that the Step-2 RFP would be forwarded to
the five (5) highest scored Offerors – Smoot, GCS Sigal, Turner, Costello and
Consigli.
Step 2 Evaluations
The CPO forwarded the Step-2 RFP to the five (5) highest-scored Offerors on
February 28, 2022. The TEP reviewed and discussed the written proposals received
on March 31, 2022. Scoring occurred after presentations on April 5, 2022, and April
7, 2022. As the library team was finishing interviews, the team received additional
information from DMPED (Office of the Deputy Mayor Planning & Economic
Development) about WMATA’s plans to develop Congress Heights Metro Station.
The Library team engaged WMATA & DMPED to understand the complexity. The
TEP chair reconvened the panel on June 3, 2022, and alerted the five firms in tandem
with the CPO. All five firms were issued additional documents received from
DMPED and WMATA and offered an opportunity to retract or re-present their design
approach with the new context. The five firms elected to proceed and re-present their
approaches. DCPL conducted the second round of presentations virtually from July
26, 2022, through August 3, 2022. Following the virtual presentations, all voting
panelists reviewed and provided updated scores. This rescoring did not change the
firm rankings.
Per the Step 2 RFP, DCPL will award the contract to the responsible Design-Builder
whose offer is most advantageous to the District, based upon the evaluation criteria
specified in the RFP. Thus, while the points in the evaluation criteria indicate their
relative importance, the total scores shall not necessarily determine the award.
Instead, the total scores shall guide the District in making an intelligent award decision
based on the evaluation criteria.
In addition to technical points, contractors could receive additional points for their
status as a Certified Business Enterprise (CBE) and points for Offeror-proposed CBE
firms mentored by the Prime Contractor as part of the DC Public Library’s Mentor
Protégé Program. See below.

The TEP concluded that Turner Construction with Perkins & Will proposal was the
most advantageous to the District of Columbia. All five evaluators allocated the
highest score to Turner Construction. The recommendation considered the evaluation
factors in the RFP, the Technical Proposals submitted by each firm, internal
deliberations of the TEP, the content presented during Presentations, discussions that
ensued, and commentary from the Community Representatives.
Letter Contract
Amount: $979,999
DC Public Library (DCPL), through its Chief Procurement Officer, entered into a
Letter Contract dated October 20, 2022, in the amount of $150,424.00 (subsequently
increased to $979,999) with Turner Construction Company to proceed with various
Phase 1 preliminary design and preconstruction services such as: 1) due diligence
reports; 2) a building program; 3) structural engineering consultation services; 4)
test pit explorations; 5) a concept design and 6) begin Schematic Design for the
project. The Letter Contract was less than $1M and did not require Council
approval.

completion of the Phase 1 Pre-Construction Services needed for the New Library in
Congress Heights.

(F) The background and qualifications of the proposed contractor, including its
organization, financial stability, personnel, and performance on past or current
government or private sector contracts with requirements similar to those of the
proposed contract:
Turner Construction was founded in 1902 and is one of the largest construction firms
in the country. For more than 30 years, the Contractor has maintained a broadening
presence in the Greater Washington region. Since 2005, The Contractor has
successfully completed renovation projects in the District of Columbia for various
agencies totaling $850,584,451.08. In September 2021, the Contractor successfully
completed the Southwest Library Design-Build project. The Library was awarded a
LEED Platinum rating by the US Green Building Council.
The Contractor possesses the financial stability to successfully perform the job and
has provided a staffing plan for the Project which has been reviewed and approved by
DCPL. The Contractor has been determined responsible in accordance with DCPL
Title 19 DCMR, Section 4368.
(G) A summary of the subcontracting plan required under section 2346 of the Small,
Local, and Disadvantaged Business Enterprise Development and Assistance Act
of 2005, as amended, D.C. Official Code § 2-218.01 et seq. (“Act”), including a
certification that the subcontracting plan meets the minimum requirements of
the Act and the dollar volume of the portion of the contract to be subcontracted,
expressed both in total dollars and as a percentage of the total contract amount:
The Contractor has certified that its subcontracting plan submission will meet the
35% minimum subcontracting requirement as required by the Act.

(H) Performance standards and the expected outcome of the proposed contract:
Performance standards under the proposed contract consist of strict adherence to the
terms and conditions of Contract No. DCPL-2022-C-0018. The performance
standard is 100% delivery of all services to the satisfaction of DCPL.

(J) A certification that the proposed contract is within the appropriated budget
authority for the agency for the fiscal year and is consistent with the financial
plan and budget adopted in accordance with D.C. Official Code §§ 47-392.01 and
47-392.02:

(K) A certification that the contract is legally sufficient, including whether the
proposed contractor has any pending legal claims against the District:
A certification by the DCPL General Counsel’s Office is attached. In addition, it
appears Turner Construction Company has no pending claims against the District.
(L) A certification that Citywide Clean Hands database indicates that the proposed
contractor is current with its District taxes. If the Citywide Clean Hands
Database indicates that the proposed contractor is not current with its District
taxes, either: (1) a certification that the contractor has worked out and is current
with a payment schedule approved by the District; or (2) a certification that the
contractor will be current with its District taxes after the District recovers any
outstanding debt as provided under D.C. Official Code § 2-353.01(b):
The Citywide Clean Hands database indicates that the proposed Contractor is current
with its District taxes.

(M) A certification from the proposed contractor that it is current with its federal
taxes, or has worked out and is current with a payment schedule approved by
the federal government:

Turner Construction Company is not certified as a local, small or disadvantaged
business enterprise as defined in the Small, Local, and Disadvantaged Business
