Pursuant to section 451 of the District of Columbia Home Rule Act (D.C. Official Code § 1-

204.51) and section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code §

2-352.02), enclosed for consideration and approval by the Council of the District of Columbia is

proposed Modification No. M0003 to contract No. CW110321 with Miles Away Charter, LLC

(Miles Away) to exercise option year one in the not-to-exceed amount of $1,378,080. The period

of performance is from August 23, 2024 to August 22, 2025.

Under the proposed modification, Miles Away shall continue to provide alternative school

transportation to students of the District of Columbia.

    November 23, 2023 (CA25-0488).

(C) A statement that Citywide Clean Hands database indicates that the proposed contractor is

    current with its District taxes. If the Citywide Clean Hands Database indicates that the

    proposed contractor is not current with its District taxes, either: (1) a certification that the

    contractor has worked out and is current with a payment schedule approved by the District;

    or (2) a certification that the contractor will be current with its District taxes after the District

    recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):

    As of May 3, 2024, Miles Away does not owe or is delinquent on any taxes with the Government of

    the District of Columbia.

(D) A statement that the proposed contract is within the appropriated budget authority for the

    agency for the fiscal year and is consistent with the financial plan and budget adopted in

    accordance with D.C. Official Code §§ 47-392.01 and 47-392.02:

The Office of the Chief Financial Officer certifies that $231,768 is available to initially fund option

year one of the contract. OSSE intends to fund throughout the period of performance based on need.

The Office of the Chief Financial Officer of the District of Columbia hereby certifies that the sum

14. Description of Amendment/Modification (Organized by UCF Section headings, including solicitation/contract subject matter where feasible.) This

modification to the Contract identified in Block 10A above is hereby modified as follows:

     1)    In accordance with Contract No. CW110321, Section F.2 “Option to Extend the term to the Contract,” the District of Columbia

           hereby exercises Option Year One of the contract. The period of performance is from August 23, 2024 through August 22, 2025.

     2)    The pricing shall be in accordance with Section B.3.2 - Option Year One. The total estimated amount for Option Year One shall not

           exceed $1,378,080. Services to be performed are subject to the issuance of a purchase order.

     3)    In accordance with section 38(d) of the Standard Contract Provisions (Way to Work Amendment Act of 2006), the living wage rate is

           hereby adjusted to $17.05 per hour, effective from January 1, 2024 through June 30, 2024. Effective on July 1, 2024, the living wage

           rate is hereby adjusted to $17.50 per hour.

     4)    Wage Determination No. 2015-4281, Revision No. 28, dated December 26, 2023, is hereby incorporated by reference.

                                    ALL OTHER TERMS AND CONDITIONS REMAIN UNCHANGED
