Proposed Firm Fixed Price Contract No. GF-2023-C-0028 by and between Consys, Inc. and the BoardofTrustees
of the University of the District of Columbia (UDC) to construct a Biomedical Research Lab on the Van Ness
Campus.
Dear Chairman Mendelson:
Pursuant D.C. Official Code §2-352.02(b)(2), enclosed for consideration and approval by the Council of the
District of Columbia is a contract between the University of the District of Columbia Board of Trustees and
Consys, Inc. to construct a specialized technological Center for Assistive Rehabilitation Research (STAR)
Biomedical Research Lab on the Van Ness Campus. The contract amount is $5,540,000.00. The work shall
‘commence on the date specified in a written Notice to Proceed to be issued by the University’s Office of
Contracting and Procurement and shall continue without interruption until completion and acceptance. The
contract shall be completed within three hundred and five (305) calendar days from the date of the Notice to
Proceed.
Consys, Inc. is a small business enterprise certified by the District's Department of Small and Local Business
Development. The contract type is a fixed price.Thecontractor shalll provide all operational support necessary to
satisfy the contract's required performance standards.

(C) The goods or services to be provided, the methods of delivering goods or services, and any
significant program changes reflected in the proposed contract:
The University of the District of Columbia (UDC) is seeking a general contractor to provide all
labor, materials, equipment and supervision for the Renovation of the approximately 11,645 square
foot area of building 32 Level B & C and building 43 Level A, on the Van Ness Campus. The Van
Ness Campus is located at 4200 Connecticut Avenue, N.W. Washington, D.C. 20008.
(D) The selection process, including the number of offerors, the evaluation criteria, and the
evaluation results, including price, technical or quality, and past performance components:
The competitive sealed bidding process was the method of procurement. This IFB was designated for the
Set-aside with a requirement that 35% be subcontracted to small businesses that is/are certified by the D.C.

Department of Small Local Business Development (DSLBD) unless the prime contractor is certified and will
perform l00% of the work. It was advertised in the Washington Times Newspaper and posted on the UDC
Website on July 3, 2023. The number of bidders was five (5), the evaluation criteria consisted of price,
preference points assigned by the DSLBD, and responsibility determination factors, and the past
performance overall rating for Consys, Inc. is excellent. Performance evaluation was conducted by Mr.
Hares Sayed, Project Manager with DGS Construction Division, Sada Anand, Project Manager with the
University of the District of Columbia, and Wayne Fraser Sr., Project Manager with the District of Columbia
Housing Authority.
There were two (2) amendments to the solicitation. Five (5) bids were received on August 3, 2023, in response to the
solicitation.

(F) The background and qualifications of the proposed contractor, including its organization,
financial stability, personnel, and performance on past or current government or private
sector contracts with requirements similar to those of the proposed contract:
The proposed contractor has adequate financial resources to perform the contract or the ability
to obtain those resources..
The proposed contractor has adequate financial resources to perform the contract and the
ability to obtain those resources. The contractor shall provide, at the time of contract award,
a 100% performance bond and 100% payment bond in the total amount payable under the
contract terms.
The Surety for this project is Swiss Re Corporate Solutions America Insurance Corporation,
located in Kansas, MO. The surety is licensed to conduct business in the District of
Columbia, as well as in Maryland and Virginia.
The proposed contractor’s EEO Employer Information Report and agreement to comply with
the requirements of Mayor's Order 85-85 was approved on October 30, 2023.
The proposed contractor’s First Source Agreement was approved on January 5, 2024.

The proposed contractor has a satisfactory record of compliance with the law, i.e., clean hands
certification First Source Agreement and Affirmation action planed approved by the Office of
Human Rights and have a license to do business in the District and is not suspended or debarred
by the district government.
The proposed contractor has the ability to obtain the necessary organization, experience,
accounting, operational control, and technical skills.
The University has no knowledge that the contractor has an unsatisfactory record of
integrity or business ethics.
(G) A summary of the subcontracting plan required under section 2346 of the Small, Local, and
Disadvantaged Business Enterprise Development and Assistance Act of 2005, as amended,
D.C. Official Code § 2-218.01 et seq. (“Act”), including a certification that the subcontracting
plan meets the minimum requirements of the Act and the dollar volume of the portion of the
contract to be subcontracted, expressed both in total dollars and as a percentage of the total
contract amount:
The CO determined that the company has a subcontracting plan that meets the 35% requirement.
The contractor’s certification number is LSDZX52129122023. The total dollar amount of the
contract is $5,450,786.00, 35% of total dollar amount of contract is $1,907,775.00. The total dollar
of all SBE/CBE to subcontractors for this contract is $1,927,840.00.
(H) Performance standards and the expected outcome of the proposed contract:
The contractor shall provide the services required according to the contract specifications, delivery
schedule and dollar amount.
(I) The amount and date of any expenditure of funds by the District pursuant to the contract
prior to its submission to the Council for approval:

(J) A certification that the proposed contract is within the appropriated budget authority for the
agency for the fiscal year and is consistent with the financial plan and budget adopted in
accordance with D.C. Official Code §§ 47-392.01 and 47-392.02:
The University of the District of Columbia’s Chief Finance Officer has certified that funds are
available in the proposed contract amount for the services required on May 1, 2024.
(K) A certification that the contract is legally sufficient, including whether the proposed
contractor has any pending legal claims against the District:
The University of the District of Columbia’s General Counsel has certified that the contract is
legally sufficient and that the contractor has no pending legal claims against the District on May 7,
2024.
(L) A certification that Citywide Clean Hands database indicates that the proposed contractor is
current with its District taxes. If the Citywide Clean Hands Database indicates that the
proposed contractor is not current with its District taxes, either: (1) a certification that the
contractor has worked out and is current with a payment schedule approved by the District;

or (2) a certification that the contractor will be current with its District taxes after the District
recovers any outstanding debt as provided under D.C. Official Code § 2-353.01(b):
The Citywide Clean Hands database certified on April 4, 2024, that the proposed contractor is
current with its District taxes.
(M) A certification from the proposed contractor that it is current with its federal taxes, or has
worked out and is current with a payment schedule approved by the federal government:
