                   IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

                                          March 5, 2024

To declare the existence of an emergency with respect to the need to approve Modifications 1

       through 4 to Contract No. GF-2021-C-0009 between the University of the District of

       Columbia and Bailey’s Real Estate Holdings, LLC, and to authorize payment for the

       janitorial services received and to be received under the contract.

        RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

resolution may be cited as the “University of the District of Columbia Modifications Nos. 1-4 to

Contract No. GF 2021-C-0009 with Bailey’s Real Estate Holdings, LLC Approval and Payment

Authorization Emergency Declaration Resolution of 2024”.

        Sec. 2. (a) Pursuant to section 451 of the Home Rule Act (D.C. Official Code § 1-

204.51) and section 202 of the Procurement Practices Reform Act of 2010, effective April 8,

2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02), on May 24, 2021, the Council

approved Contract No. GF 2021-C-0009 with Bailey’s Real Estate Holdings, LLC, for campus-

wide janitorial services at the University of the District of Columbia (“University”).

        (b) Emergency legislation is now necessary because the University failed to send past

option periods to the Council, and without Council approval on an emergency basis critical

support services necessary to the health, safety, and fulfillment of the University’s mission risks

disruption.

        (c) The University seeks retroactive approval of Modifications 1 and 2 exercised Option

Years One and Two and compensated Bailey’s Real Estate Holdings, LLC at the approved

contract amounts. Modifications 3 and 4 compensate Bailey’s Real Estate Holdings, Inc. at the

previously approved amount in 2 separate payments. Modification 3 was executed as a partial

Option Year Three from October 1, 2023 to December 2023, in the amount of $950,000.

Modification 4 exercised a partial Option Year Three from January 1, 2024 to September 30,

2024, for $2,049,950.

       Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute

emergency circumstances making it necessary that the University of the District of Columbia

Modifications 1through 4 to Contract No. GF 2021-C-0009 with Bailey’s Real Estate Holdings,

LLC Approval and Payment Authorization Emergency Act of 2024 be adopted after a single

reading.

      Sec. 4. This resolution shall take effect immediately.
