To declare the existence of an emergency with respect to the need to amend the Criminal Justice
Coordinating Council for the District of Columbia Establishment Act of 2011 to clarify
the requirement that the CJCC report aggregate programmatic data on process and
outcomes of programs.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “CJCC Data Collection Technical Correction Emergency
Declaration Resolution of 2023”.
Sec. 2. (a) On July 11, 2023, the Council passed the Prioritizing Public Safety Emergency
Amendment Act of 2023, effective July 20, 2023 (D.C. Act 25-175; 70 DCR 10358)
(“emergency act”). The emergency act included a provision requiring the Criminal Justice
Coordinating Council (“CJCC”), on a quarterly basis beginning on October 1, 2023, to collect
and post data on processes and outcomes of different approaches in the criminal justice system,
including on diversion and alternative dispositions and sentencing agreements.
(b) The intent of this provision was to improve public access to important data points
about all aspects of the criminal justice system. After consultation with partner agencies in the
criminal justice system, the Council believes that it would be helpful to clarify the language of
this provision regarding about which aspects of the criminal justice system the CJCC is required
to collect and post data.
(c) In addition, the CJCC, as well as other agencies in the criminal justice system, have
expressed that it is not feasible to compile and analyze the data required by this provision in time
to comply with the October 1, 2023, deadline. The Council therefore believes that it is prudent to
extend the deadline to December 1, 2023.
(d) Emergency legislation is necessary to extend the deadline for the CJCC to comply
with the data posting requirement and to ensure that the CJCC has the direction and authority
necessary to enable appropriate implementation of the data collection and posting prior to the
CJCC’s first posting of data.

Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the CJCC Data Collection Technical
Correction Emergency Amendment Act of 2023 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
