A RESOLUTION

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency with respect to the need to approve Contract No.
GAGA-2023-C-0248 with D.C. Central Kitchen, and Modification No. 1 thereto, for food
service management at the District of Columbia Public Schools, and to authorize
payment for goods and services received and to be received under that contract and
modification.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the “Contract No. GAGA-2023-C-0248 with D.C. Central Kitchen
Approval and Payment Authorization Emergency Declaration Resolution of 2023”.
Sec. 2. (a) There exists an immediate need to approve Contract No. GAGA-2023-C-0248
with D.C. Central Kitchen and Modification No. 1 thereto to provide food service management
at the District of Columbia Public Schools (“DCPS”) and to authorize payment for the goods and
services received and to be received under the contract.
(b) DCPS executed Contract No. GAGA-2023-C-0248, as an emergency sole source
contract, on June 22, 2023, with a term of July 1, 2023 through September 30, 2023, in the
amount of $740,319.45.
(c) DCPS now proposes to execute Modification No. 1 to the contract, which will extend
the term of the contract through December 31, 2023, and increase the contract amount by
$1,379,832.90, to a new total of $2,120,152.35.
(d) Council approval is necessary because the value of the contract, as modified, will
exceed $1 million.
(e) Approval on an emergency basis is necessary to allow the continuation of these vital
services. Without this approval, D.C. Central Kitchen cannot be paid for food services to be
provided for the period of October 1, 2023 through December 31, 2023.
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Contract No. GAGA-2023-C-0248 with
D.C. Central Kitchen Approval and Payment Authorization Emergency Act of 2023 be adopted
after a single reading.
Sec. 4. This resolution shall take effect immediately.
